These terms govern your use of NewPatientIQ ("we," "us," "our") and the services we provide. By engaging our services or using this website, you agree to these terms.
Our services
NewPatientIQ provides search-visibility and patient-acquisition analysis for psychiatry and mental health practices. This includes a scorecard, an analysis of your presence across Google search, AI assistants, your Google Business Profile, and your website, a prioritized action plan, weekly implementation recommendations, status reports, and a progress dashboard. Our role is advisory: we analyze, prioritize, and recommend. You and your team are responsible for implementing the recommended changes.
No guarantee of results
Search rankings, AI citations, traffic, and patient bookings depend on many factors outside our control, including the policies and algorithms of Google and AI platforms, your competitors, your market, and whether and how quickly your team implements our recommendations. We do not guarantee any specific ranking, traffic level, number of bookings, or other outcome. Our recommendations reflect professional judgment and current best practices, not a promised result.
Your responsibilities
- Implementing recommended changes (directly or through your web person or agency) in a timely manner.
- Providing accurate information about your practice and, where applicable, read-only access to accounts such as Google Search Console, your Google Business Profile, or website analytics.
- Ensuring you are authorized to grant any access you provide and to make the changes we recommend.
- Reviewing recommendations before implementing them.
Fees and payment
Fees, billing frequency, and any setup charges are as stated in your service agreement or invoice. Unless otherwise agreed in writing, plans are month-to-month. Fees are due as invoiced. Late or failed payments may result in suspension of services.
Term and cancellation
Unless your agreement says otherwise, services are month-to-month and either party may cancel at any time, effective at the end of the current billing period. On cancellation, we will stop work and you remain responsible for fees incurred through the end of that period. Deliverables already provided are yours to keep.
Intellectual property
The recommendations, reports, and action plans we deliver are provided for your practice's use. The methods, templates, scoring systems, software, and tools we use to produce them remain our property. You may not resell, redistribute, or repackage our deliverables or methods as your own.
Confidentiality
Each party will protect the other's non-public business information and use it only to provide or receive the services. This does not apply to information that is public, already known, or required to be disclosed by law.
Not medical, legal, or financial advice
Our services relate to marketing and search visibility. We do not provide medical, legal, or financial advice. We work only with anonymous search and listing data and do not handle protected health information (PHI). See our Privacy Policy for how we handle information.
Disclaimer of warranties
Our services and this website are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, NewPatientIQ will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the services will not exceed the amount you paid us for the services in the three months before the claim arose.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New Jersey.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of our services after a change means you accept the updated terms.
